Terms and conditions for jet ski rental
This Rental Agreement ("Agreement") is entered into between Whatcom Jet Ski Rentals ("Company") and the individual identified above ("Renter"). By signing this Agreement, Renter agrees to all terms and conditions set forth herein.
Renter acknowledges that the jet ski has been inspected prior to rental and is in good working condition. Renter is responsible for reporting any pre-existing damage to Company staff before departing. Failure to report pre-existing damage may result in Renter being held liable for such damage.
Renter agrees to return the jet ski at the agreed-upon time and location in the same condition as received, with the fuel level at or above the level at departure. Late returns will be charged at the standard hourly rate, prorated per 15-minute increment.
Jet skis are provided with a full tank of fuel. Renter is responsible for returning the vessel with a full tank or will be charged a fuel fee of $25 plus the cost of fuel required to refill.
Renter is financially responsible for any damage to or loss of the jet ski and associated equipment (life jackets, keys, etc.) that occurs during the rental period, regardless of fault, up to the full replacement value of the equipment. Damage caused by negligence or prohibited activities is not covered by any waiver of liability.
Assumption of risk and release of liability
Renter acknowledges and understands that the operation of a personal watercraft (jet ski) involves inherent risks, dangers, and hazards, including but not limited to:
Renter voluntarily assumes all such risks, both known and unknown, associated with the rental and operation of the jet ski.
In consideration of being permitted to rent and operate a jet ski from Whatcom Jet Ski Rentals, Renter, on behalf of themselves, their heirs, personal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue Whatcom Jet Ski Rentals, its owners, officers, employees, agents, and representatives (collectively "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Renter or any passenger, whether caused by the negligence of the Released Parties or otherwise.
Renter agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from Renter's use of the jet ski, including claims made by third parties for injury or property damage caused by Renter's operation of the watercraft.
Renter acknowledges that a U.S. Coast Guard-approved personal flotation device (PFD/life jacket) is provided and must be worn at all times while operating or riding the jet ski. Failure to wear a life jacket is a violation of Washington State law and this Agreement.
Renter certifies that they are in good physical health and are not aware of any medical condition that would prevent safe operation of a personal watercraft. Renter acknowledges that operating a jet ski requires physical exertion and quick reaction time.
This waiver shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes arising hereunder shall be resolved in Whatcom County, Washington.
If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Deposit terms and conditions
A refundable security deposit of $500.00 USD per jet ski is required at the time of rental. The deposit may be paid by credit card, debit card, or cash. Credit/debit card holds will be released within 3–5 business days following the return of the equipment, subject to inspection.
The security deposit will be fully refunded when all of the following conditions are met:

All equipment is photographed and documented before and after each rental. The Company's damage assessment is final and binding. Renter will be provided with a written damage report and cost estimate if any deductions are made from the deposit.
Refunds, rescheduling, and no-show terms
Whatcom Jet Ski Rentals understands that plans change. Our cancellation policy is designed to be fair to both our customers and our business operations:
Cancellations must be submitted in writing via email or text message to Whatcom Jet Ski Rentals. Verbal cancellations are not accepted. The cancellation time is determined by when the written notice is received by the Company, not when it is sent.
Renter may reschedule their reservation one time at no charge if notice is provided at least 48 hours before the original rental time, subject to availability. Additional rescheduling requests may be subject to a $25 rescheduling fee. Rescheduled rentals must occur within 90 days of the original booking date.
Whatcom Jet Ski Rentals reserves the right to cancel or postpone rentals due to unsafe weather conditions, including but not limited to high winds, lightning, heavy rain, or poor visibility. In the event of a Company-initiated weather cancellation:
The Company's determination of unsafe conditions is final. No compensation is provided for weather conditions that develop after the rental has commenced.
In the rare event of equipment failure that prevents the rental from occurring, Renter will receive a full refund or the option to reschedule at no charge. If equipment failure occurs during a rental, a prorated refund will be issued for the unused portion of the rental time.
The security deposit is always fully refunded upon cancellation, regardless of when the cancellation occurs, provided no damage has been incurred. Security deposit refunds are processed within 3–5 business days.
Reservations of 3 or more jet skis are considered group bookings and are subject to a separate cancellation policy. Group bookings require 50% non-refundable deposit at time of booking. Please contact us directly for group booking terms.
